1. Object

These general terms and conditions of sale define the rights and obligations of WRONG SIDE SOCKS and the Customer regarding products presented by WRONG SIDE SOCKS on its website www.wrongsidesocks.com (hereinafter "the Site").

They apply exclusively between:

  • Lionel Hagege, owner of the trademarks "WRONG SIDE SOCKS" and "WRONG SIDE";
  • Groupe Nesse, 66 avenue des Champs-Élysées, 75008 Paris, France, which commercialises the socks (hereinafter the "Seller").

On the Site, WRONG SIDE SOCKS allows the Customer to order online products of the brand WRONG SIDE SOCKS (hereinafter "the Product(s)") according to these general conditions. Any order placed with WRONG SIDE SOCKS implies the Customer's unreserved acceptance of these terms and conditions.

These Terms may be amended from time to time. The version applicable to the Customer is the one in force on the date of the order. These conditions are permanently accessible at: www.wrongsidesocks.com/terms.

2. Customer Obligations

2.1. The Customer declares to be at least 18 years old and to have the legal capacity or to have parental authorization allowing him to place an order on the Site.

2.2. The Customer agrees to provide WRONG SIDE SOCKS with accurate and necessary information for the performance of the service covered by these terms and conditions, including their full name, address, telephone number, and valid email address. The Customer is responsible for any consequences arising from the provision of false or inaccurate information.

2.3. Once the order has been placed, WRONG SIDE SOCKS sends the Customer an email confirming it and informs them of the shipment.

3. Order

3.1. All orders will only be validated after payment has been accepted. No modifications or cancellations are possible after order validation and receipt of the confirmation email.

3.2. WRONG SIDE SOCKS reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order.

3.3. WRONG SIDE SOCKS accepts orders subject to stock availability. In the event of unavailability, WRONG SIDE SOCKS will inform the Customer as soon as possible. The Customer may then cancel their order and receive a refund. The unavailability shall in no case engage the liability of WRONG SIDE SOCKS.

4. Price

The prices displayed on the Website are indicated in euros and include applicable taxes (VAT), excluding shipping costs, license fee, and packaging costs. These costs will be indicated in the shopping cart before final validation. Items will be billed based on the rates in effect at the time the order is placed.

5. Delivery

5.1. WRONG SIDE SOCKS delivers in all countries. Products are shipped to the address provided by the Customer. Delivery cannot be made to hotels or P.O. boxes.

5.2. Delivery times are estimates. If delivery is delayed beyond the estimated time, the Customer may contact WRONG SIDE SOCKS to request delivery within a reasonable additional period. If the products are still not delivered, the Customer may cancel the order.

5.3. In the event of damaged packages, the Customer undertakes to notify the carrier and WRONG SIDE SOCKS of any reservations within 3 days of receiving the product.

6. Payment

Full payment is due at the time of order. The Customer may pay by credit card (Visa, Eurocard/Mastercard), PayPal account, or bank transfer. WRONG SIDE SOCKS does not accept payment by check.

The communication by the Customer of their bank card number constitutes authorization for WRONG SIDE SOCKS to debit their account. WRONG SIDE SOCKS retains ownership of the item until full payment. All transactions are 100% secure.

7. Product Returns and Refunds

Right of withdrawal: For online purchases, the Customer may withdraw within 14 days from the day they take physical possession of the Products, without justification.

Return Conditions: Products must be in original packaging, original condition, new, unworn, and unwashed with labels intact. Returns are at the Customer’s risk.

Fees: Return shipping costs are borne by the Customer. If a return label is provided, a fixed fee of €10.00 may be deducted from the refund.

Exclusions: Items that are personalized or made to order cannot be returned or exchanged.

8. Guarantees and Liability

WRONG SIDE SOCKS is only bound by an obligation of means. It cannot be held liable for any damage inherent to the use of the internet (service interruptions, viruses) or for any event considered force majeure.

9. Intellectual Property

WRONG SIDE SOCKS and WRONG SIDE are trademarks owned by Lionel Hagege. The Website or any part of it may not be reproduced, copied, or exploited for commercial purposes without express written permission. All copyrights and trademarks remain the full property of WRONG SIDE SOCKS.

10. Data Protection & Privacy

Personal data is subject to processing for order management and legal obligations. In accordance with the GDPR (EU 2016/679) and the French Data Protection Act, the Customer has the right of access, rectification, erasure, and objection. Requests can be sent to infos@wrongsidesocks.com. The Customer also has the right to lodge a complaint with the CNIL.

11. Force Majeure

Cases of force majeure (strikes, lockouts, riots, severe weather, epidemics, computer failures, etc.) suspend all obligations of the parties. If the event continues for more than 3 months, the contract may be terminated automatically without compensation.

12. General Provisions

12.1. Partial invalidity: If any provision is declared invalid, it shall be deemed unwritten and shall not invalidate the remaining provisions.

12.2. Update These Terms may be amended from time to time. Any updated version will be published on the Website and will apply only to orders placed after it is published. The version applicable to the Customer is the one in force on the date of the order. These Terms are permanently accessible at: www.wrongsidesocks.com/terms in a format allowing them to be stored and reproduced..

12.3. Applicable Law – Jurisdiction: These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought. Failing that, for Professionals, jurisdiction is granted to the courts of Paris, France.

12.4. Statutory Warranties: The Customer benefits from the legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and 1648 of the French Civil Code).
